Article1ThisLawisformulatedinaccordancewiththeConstitutionandtheactualsituationinourcountrydrawinguponourpracticalexperienceincivilactivitiesforthepurposeofprotectingthelawfulcivilrightsandinterestsofcitizensandlegalpersonsandcorrectlyadjustingcivilrelationssoastomeettheneedsofthedevelopingsocialistmodernization.
Article2TheCivilLawofthePeople'sRepublicofChinashalladjustpropertyrelationshipsandpersonalrelationshipsbetweencivilsubjectswithequalstatusthatisbetweencitizensbetweenlegalpersonsandbetweencitizensandlegalpersons.
Article3Partiestoacivilactivityshallhaveequalstatus.
Article4Incivilactivitiestheprinciplesofvoluntarinessfairnessmakingcompensationforequalvaluehonestyandcredibilityshallbeobserved.
Article5Thelawfulcivilrightsandinterestsofcitizensandlegalpersonsshallbeprotectedbylaw;noorganizationorindividualmayinfringeuponthem.
Article6Civilactivitiesmustbeincompliancewiththelaw;wheretherearenorelevantprovisionsinthelawtheyshallbeincompliancewithstatepolicies.
Article7Civilactivitiesshallhaverespectforsocialethicsandshallnotharmthepublicinterestunderminestateeconomicplansordisruptsocialeconomicorder.
Article8ThelawofthePeople'sRepublicofChinashallapplytocivilactivitieswithinthePeople'sRepublicofChinaexceptasotherwisestipulatedbylaw.
ThestipulationsofthisLawasregardscitizensshallapplytoforeignersandstatelesspersonswithinthePeople'sRepublicofChinaexceptasotherwisestipulatedbylaw.
ChapterIICitizen(NaturalPerson)
Section1CapacityforCivilRightsandCapacityforCivilConduct.
Article9Acitizenshallhavethecapacityforcivilrightsfrombirthtodeathandshallenjoycivilrightsandassumecivilobligationsinaccordancewiththelaw.
Article10Allcitizensareequalasregardstheircapacityforcivilrights.
Article11Acitizenaged18orovershallbeanadult.Heshallhavefullcapacityforcivilconductmayindependentlyengageincivilactivitiesandshallbecalledapersonwithfullcapacityforcivilconduct.
Acitizenwhohasreachedtheageof16butnottheageof18andwhosemainsourceofincomeishisownlabourshallberegardedasapersonwithfullcapacityforcivilconduct.
Article12Aminoraged10orovershallbeapersonwithlimitedcapacityforcivilconductandmayengageincivilactivitiesappropriatetohisageandintellect;inothercivilactivitiesheshallberepresentedbyhisagentadlitemorparticipatewiththeconsentofhisagentadlitem.
Aminorundertheageof10shallbeapersonhavingnocapacityforcivilconductandshallberepresentedincivilactivitiesbyhisagentadlitem.
Article13Amentallyillpersonwhoisunabletoaccountforhisownconductshallbeapersonhavingnocapacityforcivilconductandshallberepresentedincivilactivitiesbyhisagentadlitem.
Amentallyillpersonwhoisunabletofullyaccountforhisownconductshallbeapersonwithlimitedcapacityforcivilconductandmayengageincivilactivitiesappropriatetohismentalhealth;inothercivilactivitiesheshallberepresentedbyhisagentadlitemorparticipatewiththeconsentofhisagentadlitem.
Article14Theguardianofapersonwithoutorwithlimitedcapacityforcivilconductshallbehisagentallitem.
Article15Thedomicileofacitizenshallbetheplacewherehisresidenceisregistered;ifhishabitualresidenceisnotthesameashisdomicilehishabitualresidenceshallberegardedashisdomicile.
